Water damaged caused from not within a system



The policy does not define damages caused from a source "not within the system." However, the policy does state that it covers accidental, direct, physical loss unless identified as a peril not covered or a cause of loss excluded. Thus, damages from a source "not within a system" is covered unless the policy states otherwise. You then need to know the source of your loss and determine if this source or cause of loss is not covered, excluded, or limited in your policy.


Water damage " not within a system" may include the following sources. I have identified these sources as 1. and 2. The sources of loss in 1. usually pay for damages to the dwelling, other structures, and personal property. If the cause or source of loss is listed in 2. below, the carrier may deny your loss.

1. shingles, roofing tiles, metal roofing, roll roofing, modified bitumen, flashing, vents, fascia, drip edge, siding, bricks, blocks, windows, doors.
2. a fish tank, water bed, above ground pool, bottle water dispensers, bucket of water, and a glass of water.


Limitations and Exclusions
This loss is excluded if the source of the water is from a constant or repeated seepage or leakage of water or steam, or the presence or condensation of humidity, moisture or vapor; which occurs over a period of 14 or more days.
Water damage to Personal property is not covered unless the force of wind or hail causes an opening in a roof or wall and the rain, snow, sleet enters through this opening.
Personal property may be excluded if damaged by the sources of loss identified under 2. However, if a covered proximate cause of loss first causes damages to the items listed in 2. and then the water damages to your personal property, you may have coverage. For instance, a tree comes through a window and knocks over a fish tank and the water damages a dresser. Normally, the loss to a dresser is not covered when damaged by water from a fish tank but in this instance, I believe coverage exists. The wind is the proximate cause of loss and personal property is covered for wind damage.
